Terms of Use
1. Acceptance of Terms.
These terms and conditions constitute a part of the contract between Quad Studios Ltd and Client. Different or additional terms and conditions which may be included in Client's purchase order or other acceptance of this quotation are hereby rejected unless approved in writing by the director of Quad Studios Ltd.
2. Terms of Payment.
Payment to be made in advance via the secure online payment system run by Protex or via Streamline over the phone. Cash payments prior to rehearsal subject to availability are also available. If Client defaults in payment of any invoice at due date, or in the event of any proceeding in bankruptcy or insolvency by or against Client, Quad Studios Ltd, in addition to any right it has, shall have the right: (a) to suspend or discontinue work until it has received payment in full for work performed; (b) to require cash in advance to cover further work; (c) to collect late charges of 5 1/2% over bank base rate per month from due date; and/or (d) to recover all costs of collection, including reasonable lawyers fees. In the event credit or financial ability of Client becomes impaired or unsatisfactory in the sole reasonable judgment of Quad studios, Quad studios shall have the right at any time thereafter to change the credit terms with respect to any further work under this quotation.
3. Changes in Specifications & Cancellation.
Any cancellations or alterations to bookings must be made within 48 hours and confirmed in writing from Quad studios. After acceptance of initial quotation changes by Client in the specifications will not be binding on Quad studios unless Quad studios consent to such changes in writing. Any additional charges for accepted changes will be billed to Client. Cancellations of bookings must be made within 48 hours or Client will be billed for hours of booked time.
4. Damages and Risk of Loss.
Clients are responsible for all equipment and rooms hired. Damages and theft to said will result in charges on a repair or replace basis or criminal prosecution. Quad studios do not accept liability for loss of personal items from site or car park. We request clients to secure their own property.
For recording, mixing, editing of audio and visual media - All risk of damage or loss to recorded works at any time is assumed by Client, and such damage or loss shall not in any way release Client from any of its obligations hereunder. Client agrees that Quad studios shall not be liable for any special, incidental or consequential damages, including without limitation lost income or profits, resulting from damage or destruction to the work prior to delivery.
5. Equipment Storage & sound Materials.
Secure storage of equipment, musical or otherwise, is at Client's risk and must be paid in advance. All sound and video data stored on whatever format (HD, tape minidisk etc) or on our computer network is at Clients own risk. Quad Studios accepts no liability for theft, loss or degradation.p>
6. FTP Site.
Upon request from Client, Client materials may be made accessible to Quad studios or Client on Quad studio’s password protected FTP site. Client agrees to adhere to all Quad studios FTP site policies as the same may be provided to Client from time to time. Quad studios are not responsible for any unauthorized use or access to said site or materials. A fee may be applied for access to Quad studios FTP site.
